Terms and Conditions

These Terms and Conditions ("Agreement") govern your access to and use of the BharatBilty mobile application, website, and digital transport software platform. By creating an account or using our services, you agree to be bound by these terms.

1. Account Registration & Transporter Responsibilities

• You must provide accurate and verifiable business details, including legal business name, contact information, and applicable GSTIN/PAN during account registration.
• You are responsible for maintaining the confidentiality of your account credentials and for all documents issued under your login.
• BharatBilty provides document generation software; the transport operator remains solely responsible for the accuracy of freight rates, goods valuations, driver details, and physical transport operations.

2. Subscription Plans & Billing

• Free Starter Plan: Includes up to 15 free bilty and invoice documents per month with standard features.
• Paid Pro & Enterprise Plans: Billed on a recurring monthly or annual basis. Subscriptions grant access to unlimited document generation, custom branding, and priority support.
• Payments are processed securely via authorized Indian payment gateways. You may cancel your subscription at any time; your plan will remain active until the end of the paid billing cycle.

3. Legal & Regulatory Compliance

All users agree to use BharatBilty exclusively for lawful logistics, relocation, and freight billing purposes in compliance with the Carriage by Road Act 2007, Motor Vehicles Act, and applicable Goods and Services Tax (GST) legislation. Generating fraudulent invoices or issuing fictitious bilty without actual consignments is strictly prohibited and will result in immediate account termination.

4. Intellectual Property

The BharatBilty software, interface designs, logos, algorithms, and brand assets are the exclusive intellectual property of BharatBilty Solutions. You retain all ownership rights to your uploaded company logos, signatures, and document records.

5. Limitation of Liability

BharatBilty provides software tools on an "as-is" and "as-available" basis. We are not liable for physical transit damages, carrier-shipper commercial disputes, road accidents, or delayed shipments, as we operate solely as a digital documentation provider and not as a freight carrier or broker.

6. Modifications & Governing Law

We reserve the right to update these terms as software features and regulations evolve. Continued use constitutes acceptance of the revised terms. This Agreement is governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts in Siliguri / West Bengal, India.
